The pit bull breed ban in the city of Louisburg has been lifted with action taken by the Louisburg City Council at its June 6 meeting. At the same meeting, the council passed two new ordinances that strengthen the dangerous and vicious animal laws inside the city limits. Both ordinances were unanimously approved by the five-member council and went into effect June 15 after publication in the official city newspaper.
Under the new ordinance a dangerous animal is one that is defined that either attacks or bites any person or domestic animal or has attacked or bitten a person or domestic animal; the animal has a known propensity, tendency or disposition to attack, cause injury or threaten the safety of persons or domestic animals; such animal which in a vicious or threatening manner approaches any person in apparent attack upon that person while on the streets, sidewalks or public grounds or places or on private property; or any animal because of its size, physical characteristics and vicious propensities is capable of inflicting serious physical injury or death to a person.
An animal will not be deemed dangerous if it were protecting the premises from willful trespass; if a person was provoking, teasing, tormenting, abusing or assaulting the animal; a person was attempting to commit or committing a crime; or if another animal was provoking, tormenting, abusing or assaulting the animal.
The owners of such animals can be cited and ordered to appear in Municipal Court. If the court determines the animal is dangerous, the animal can be destroyed by humane means, ordered to be removed from the city or allowed to stay inside the city limits with several stipulations. These stipulations include that animal must always be on a leash and muzzled outside of its kennel either in the yard or outside the yard; must otherwise remained confined either indoors or in an outdoor kennel; may not be kept on a porch or patio in which the animal may exit on its own and if kept indoors must not be able to break through a screen or door; the owner must post signage stating a “dangerous animal” is on the property; must maintain a $1 million liability insurance with the city named as additionally insured; must provide an identification photograph to animal control; animal must be microchipped and have a city animal tag; must be spayed/neutered; may not sell or transfer ownership of the animal; must not be within 400 feet of a school, park or public playground; and the owner must be 18 or over.
Additionally any animal that has been deemed dangerous by municipal court, and has caused serious injury to, or killed any person or domesticated animal, shall be impounded by the city and shall be euthanized.
